Appellate Litigation

Schertler Onorato Mead & Sears has substantial experience in the state and federal appellate court system and regularly represents clients in criminal and civil appeals, other post-trial proceedings, and in the preparation and filing of petitions for a writ of certiorari. Our appellate practitioners include Lisa Hertzer Schertler, a former Assistant to the Solicitor General and former Deputy Chief of the Appellate Division in the United States Attorney’s Office for the District of Columbia. Through successful appellate briefing and argument in the federal Courts of Appeals, we have secured reversals of federal criminal convictions and/or sentences in numerous cases, including the reversal of a mandatory thirty-year prison sentence on Eighth Amendment (i.e., cruel and unusual punishment) grounds. In addition to handling civil and criminal appeals on a regular basis, we have represented regulated entities in petitions for review of agency proceedings. In all appellate matters, we strategize with our clients on the optimal approach to issue selection, briefing, and oral argument.
