On May 29, 2025, a federal district court in the District of Columbia dismissed with prejudice a criminal Information charging a Schertler Onorato & Mead Sears client with making false statements in labor union reports in violation of the Labor-Management Reporting and Disclosure Act (LMRDA). The dismissal followed issuance of an Executive Grant of Clemency granting a full and unconditional pardon to the client, a respected labor leader who served in various roles in the International Union of Operating Engineers (IUOE) for more than forty years, including thirteen years as IUOE General President. SOMS attorneys David Schertler, Danny Onorato, and Tara Tighe represented the client in the criminal case and negotiated a pre-indictment plea involving a single misdemeanor charge under the LMRDA. President Donald Trump issued the pardon the day before the client was scheduled to be sentenced. In anticipation of the sentencing, dozens of IUOE members and other supporters filed letters with the Court praising the client for his visionary leadership of the IUOE and his lifelong commitment to IUOE members and their families.
