May 2017: S&O Obtains Misdemeanor Plea and Unsupervised Probationary Sentence in Federal Internet Pharmacy Case

In the United States District Court for the District of Columbia, Schertler & Onorato attorneys David Schertler, Lisa Schertler, and Shermineh Jones obtained a misdemeanor plea and a sentence of unsupervised probation for a pharmacist who originally was charged in a four-count federal indictment that included felony charges under both the Controlled Substances Act and the Federal Food, Drug & Cosmetic Act relating to Internet sales of prescription drugs.  In August 2016, S&O prevailed on a motion to dismiss all the Controlled Substances Act counts.  The motion raised new meritorious arguments concerning a legal issue on which several other federal courts had ruled in the government’s favor.  S&O then negotiated a plea agreement for a single misdemeanor, on which the firm’s client was sentenced to unsupervised probation and a monetary fine.
